Terms of Service

Rascador is a product of Torvion Labs, a business registered in Malawi under the Business Registration Act (No. 12 of 2012), based in Lilongwe. “We” and “us” mean Torvion Labs.

We provide an API that returns structured product, category and search data collected from third-party online marketplaces, together with a dashboard for managing API keys, quota and billing (the “Service”).

These terms form an agreement between you and us. If you are agreeing on behalf of a company, you confirm you are authorised to bind it, and “you” means that company.

You need an account to use the Service. You are responsible for everything done with your account and with any API key issued to it, including by your team members.

API keys are credentials. Treat them as secrets: do not commit them to source control, embed them in client-side code, or share them outside your organisation. You can revoke and rotate keys at any time from the dashboard, and you should do so immediately if a key may have been exposed. We are not liable for use of the Service made with your keys before you revoke them.

You agree not to use the Service to:

• break any law that applies to you, or infringe anyone’s rights;
• resell or redistribute raw responses as a substantially similar competing data product;
• circumvent quota, rate limits or per-key limits, including by creating multiple accounts to obtain additional free allowance;
• attempt to gain unauthorised access to the Service, other customers’ data, or the infrastructure behind either;
• collect or infer personal data about individuals from marketplace listings, such as seller or reviewer identities.

You are responsible for your own compliance with the terms of any marketplace whose data you consume through us, and for the legality of what you do with that data in your jurisdiction.

Usage is metered in credits rather than per request. Serving a response costs one credit per twenty records or 128 KiB, whichever runs out first, and each product you have not been served before in the billing period costs a further three credits. A product fetched live costs five credits, a live search ten, and a forced refresh fifteen. Your plan sets a monthly credit allowance, a limit on product pages per ten minutes, and rate limits, and you may set lower limits on individual keys.

When an allowance is exhausted, live keys return HTTP 402 until the period resets or you change plan. We may apply reasonable technical limits to protect the Service, and may change quota weights on notice.

We aim for high availability but do not promise uninterrupted service. The Service depends on third-party marketplaces whose availability, structure and terms are outside our control; data may be incomplete, delayed or unavailable as a result.

Data returned by the Service is collected from public marketplace pages and is provided “as is”. We do not warrant that it is complete, current or accurate, and you should not rely on it as the sole basis for a pricing, purchasing or trading decision without your own verification.

Marketplace content, including product descriptions and images, remains the property of its respective owners. Nothing here transfers rights in that content to you.

Paid plans are billed in advance, monthly or annually, at the price shown on our pricing page when you subscribe. Additional team seats beyond those included are charged per seat.

Paddle.com Market Ltd is the merchant of record for all orders. Paddle handles payment, billing enquiries, invoices and sales tax or VAT, and their name appears on your statement. Your purchase is also subject to Paddle’s own buyer terms.

If a payment fails, we allow a grace period before live access is suspended; test keys keep working throughout. Refunds are covered by our refund policy.

We may change prices. Changes take effect at your next renewal, and we will give you reasonable notice before they do.

You may cancel at any time from the dashboard. Cancellation takes effect at the end of the period you have already paid for; you keep access until then and are not charged again.

We may suspend or terminate an account that breaches these terms, that is used in a way that threatens the Service or other customers, or where required by law. Where the breach is capable of being fixed, we will normally tell you and give you a chance to fix it first.

To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost revenue, or lost or corrupted data arising from your use of the Service.

Our total liability arising out of or in connection with these terms is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence.

We may update these terms. If a change materially reduces your rights we will give notice before it takes effect, by email or in the dashboard. Continuing to use the Service after that point means you accept the updated terms.

These terms are governed by the laws of Malawi, and the courts of Malawi have exclusive jurisdiction over any dispute arising from them.

If you are a consumer, this does not deprive you of the protection of mandatory consumer law in your own country of residence, nor of the right to bring proceedings there where that law gives you it.
